Comunicado de Prensa
La Campaña Nacional por el Derecho al Aborto Legal, Seguro y Gratuito acompaña a la presentación del Recurso Extraordinario Federal que se realizará ante la Corte Suprema de Justicia de la Nación, el día 6 de abril próximo.
El objetivo de este recurso es que la Corte resuelva sobre la inconstitucionalidad de los fundamentos del veto a la ley 2394/07 aprobada por mayoría absoluta en la Legislatura de la Provincia de La Pampa y vetada el 17 de diciembre de 2007 por el gobernador Oscar Mario Jorge.
La ley mencionada, reglamenta un procedimiento para el cumplimiento del artículo 86 del Código Penal Argentino, referido a los abortos no punibles con el objetivo de que las/os médicos tengan resguardo jurídico para efectuar los abortos legales de manera eficaz, evitando la judicialización y a las mujeres les garantice que se cumplan sus derechos.
En lo que consideramos constituye un grave retroceso, la ley fue vetada argumentando su inconstitucionalidad.
A partir de esta situación el Foro Pampeano no al veto y sus representantes legales plantean como estrategia la presentación de una Acción Declarativa de Inconstitucionalidad (ADI) ante el Superior Tribunal de la Provincia de La Pampa, que lo rechazó el día 23 de marzo del corriente año.
En el marco de la lucha por una “Educación Sexual para decidir, anticonceptivos para no abortar y aborto legal para no morir”, la Campaña Nacional por el Derecho al Aborto Legal, Seguro y Gratuito exige al estado argentino en general y a cada uno de sus poderes en particular que cumplan las leyes vigentes, y que legislen las necesarias para garantizar la autonomía y el derecho a decidir de las mujeres.
